Terms and conditions for JinKei consultations, training and retreats

Article 1 Applicability

1.1. These Additional Terms and Conditions for Treatments, Consultations and Training (hereinafter referred to as: Additional Terms and Conditions for Consultations and Training) of JinKei apply in addition to the General Terms and Conditions for Internet Sales. The General Terms and Conditions for Internet Sales are an integral part of these Additional Terms for Consultations and Training of JinKei. These conditions apply to all workshops, treatments, consultations, training and related services of JinKei.

1.2 By participating in a treatment, consultation or training, the participant agrees to the applicability of the General and Additional Terms and Conditions for consultations and training. The fact that a natural person (or legal entity) books or orders through the JinKei website implies full understanding and full acceptance of these Consultation and Training Additional Terms, which is expressly acknowledged by the customer, who in particular waives, to use making any contradictory document, which would be unenforceable for JinKei.

1.3 These Additional Terms and Conditions for consultations and training apply to all legal relationships between the Reiki Master and/or Reiki practitioner working under the JinKei website (hereinafter referred to as: Reiki Master or JinKei) and the client (hereinafter referred to as: student, user, client or customer).

1.4 By accepting the offer, agreement and/or invoice, the customer declares to be aware of these provisions and to accept them without reservation.

1.5 All quotations and offers from JinKei are without obligation, unless a term for acceptance has been set in the quotation. If no acceptance period has been set, the offer will always expire after 14 days.

1.6 The agreement between JinKei and the customer is entered into for a definite period of time, unless the nature of the agreement dictates otherwise or if the parties expressly agree otherwise in writing.

1.7 If reference is made to the activities as a Reiki Master of JinKei, this also includes the activities as a Reiki practitioner/consultant and Reiki teacher/trainer in the broadest sense of the word, and all other activities that can be performed on the basis of the services offered. 

1.8 When referring to the customer/student/user/client, this refers to the natural or legal person who has concluded an agreement with JinKei.

1.9 When talking about a treatment, this also means a consultation or an informative appointment, which may also involve a Reiki treatment. These treatments can take place on site in JinKei's practice, remotely or online.

1.9 During the term of the agreement, the terms and conditions may be changed by JinKei. The last published version is always the current version and available on the website.

Article 2 Definitions

2.1. Terms and Conditions

These general terms and conditions used by JinKei, which are published on the JinKei website.

2.2. Gift voucher

A personal voucher issued by JinKei, which represents a certain value, to be spent at JinKei.

2.3. Participant

The person who follows or wishes to follow a training, treatment, consultation or retreat organized by JinKei. (In these terms and conditions also referred to as student, user, client or customer).

2.4. Loose treatment. A one-time treatment to be paid for and followed by a student at JinKei, other than on the basis of a series of treatments.

2.5. Consultation series

A sequence of multiple consultations by JinKei, in consultation with the client. The client pays an amount that is proportional to the number of treatments that fall under this series.

2.6. training

A (Master) training or Reiki training to be given or given at JinKei.

2.7. Agreement

The purchase agreement between customer and JinKei

2.8. Website

Article 3. Registration/booking of services offered

Registration for one of the services offered by JinKei on the website takes place by means of booking or registration via the website or by registration via email. A personal profile is created where all data of the customer in question can be found and with which all services can be booked. All services offered must be pre-booked and a seat is not reserved until JinKei confirms the booking. The customer is obliged to book the desired service in advance before coming to the practice. JinKei reserves the right to refuse a customer who has not pre-booked the service.

3.1. Treatments and consultations

A participant can participate in treatment and/or consultation after he has made a booking via the website and JinKei has paid the full amount for participation in the program. has received the chosen treatment or consultation (with due observance of the payment term). The treatments and/or consultations are given on the basis of the schedule provided by JinKei and at the location indicated by JinKei. In addition, it is possible that a treatment takes place online or remotely, if the customer books this product. JinKei reserves the right to change the schedule at any time. Any changes will, as far as possible, be announced in advance by JinKei by email.

3.2 Cancellation by JinKei

JinKei reserves the right to cancel a planned treatment and/or consultation due to force majeure. In that case, a new date will be determined in reasonableness and fairness in consultation with the customer.

3.3 Cancellation

The participant can cancel his booking free of charge up to one month before the planned treatment and/or consultation. This can be done by email to info@Jinkei.fr. The participant can cancel his booking up to seven days before the planned treatment, in which case the registration fee will be refunded after deduction of 50% of the participation or registration fee already paid plus € 25 administration costs. If the participant cancels his registration within seven days before a planned treatment, no registration fee will be refunded or refunded of the contributions already paid for participation.

4. Training

4.1 Books

A participant can participate in a training after JinKei has received the full amount for participation in the training (with due observance of the final payment term).

4.2 Cancellation by JinKei

JinKei reserves the right to cancel a scheduled training due to force majeure.

4.3 Admission and cancellation

Entries will be processed in the order in which they are received (registration via the site or by email + (down) payment). After receipt of the registration, a personal intake may take place by e-mail. In this, the teacher and the participant discuss any questions about the content of the training, the admission and the level of the current participant. After this intake, the participant will be notified asap whether he has been admitted to the training. In case the participant is not admitted, the deposit will be refunded immediately.

Participation in the training is automatically final after receipt of the due training fee. When the participation in the training is final, the participant is obliged to pay the full training fee (on time). Cancellation is therefore no longer possible. After payment of the full training fee, no refund is possible (even partially). If payment in installments is chosen, the participant is obliged to pay all installments, even if the participant would stop the training in the meantime.

4.4. catching up lesson

For the continuity of the training, it is recommended not to deviate from the established training schedule. In case of urgent need, a training can be rescheduled in consultation with JinKei. The completion of the training is automatically postponed. However, it is strongly recommended to complete and complete training courses once started, unless there are plausible reasons and arguments to end the training early. This is always done in consultation with the Reiki Master. Pausing a training is only possible in the cases referred to in Article 9.3. The student is responsible for continuity in the participation of the lessons. No financial arrangement is made for classes that have not been attended. No refund of the paid (full) training fee is owed by JinKei under any circumstances.

Article 5 Online training courses

In addition to the provisions referred to in Article 4, the following additional provisions apply to online training.

5.1 Definition of the workout. All training given and/or provided by or on behalf of JinKei, including individual training, group training, lectures, workshops, in-company training and online training.

Article 6 Conclusion of the agreement

6.1 The agreement between JinKei and the client and/or student can be concluded by:

1. creating a personal account on the website; either/or

2. payment of the full training fee due within the set payment term; either/or

3. by confirmation of the offer by the client by e-mail. Every quotation for a training and/or coaching is in principle without obligation and remains valid for fourteen working days, unless otherwise indicated by JinKei. JinKei is only bound by a quotation if it is confirmed by the client by email within fourteen working days and payment has been received within the set payment term. All prices indicated in the quotation are in euros and include VAT, unless stated otherwise. VAT is charged on all training courses, coaching and workshops.

Article 7 Cancellationing and termination

7.1 JinKei is entitled to terminate the agreement with the client and/or student with immediate effect if the minimum number of required participants in the reserved training, which is necessary for the relevant training to continue, is not met. The student is informed by JinKei when booking the training if a minimum number of participants is required.

7.2 In case of force majeure. See article 12.

Article 8 Payment

8.1 JinKei will charge the fees owed by the client and/or student by means of an invoice. For the online training courses, the user/student will only be given access to the online training when the student has created a personal account and the relevant fee has been paid in full. The relevant content and/or services and/or products from JinKei can then be used immediately before the withdrawal period as referred to in the Distance Selling Act has expired. The user's/student's right of withdrawal under the Distance Selling Act is expressly excluded for that reason.

Article 9 Creating and using an account

9.1 By creating an account, user agrees to JinKei's Terms and Conditions. After purchasing an online training, the user has access to this training via the personal account for a period of at least one year. After the expiry of this period, the personal account will automatically expire. With this personal account, the user acquires a personal, revocable, limited, non-exclusive, non-sub-licensable, non-transferable, right to view the Content made available (whether or not for a fee) through the Website and/or listen and/or study.

9.2 The user is not allowed to grant third parties access to his/her account and/or the content to which this account gives access. User is personally responsible for keeping the login details associated with his/her account confidential.

9.3 Users under the age of 16 need permission from their parent(s) or guardian to create an account. By accepting these Terms and Conditions, the user indicates that he is older than 16 years of age or has permission from a parent or guardian.

Article 10 Intellectual property

10.1 All intellectual property rights (including but not limited to copyrights and trademark rights) in JinKei's websites and content (including but not limited to all training materials, online training, videos, voice recordings, infographics and all content) rest solely with JinKei , insofar as those rights do not (also) belong to third parties. The user is not permitted to copy, download, reproduce, edit or distribute (parts of) the Website and/or content in any way and in any form and for whatever purpose without JinKei's prior written permission. .

The user is only allowed to download content (whether or not for a fee) for personal use. It is not allowed to remove, obscure, hide or change any notices or mentions regarding intellectual property rights.

Article 11 Validity

11.1 Non-compliance with the appointment without notice by customer

If the customer is not present at the agreed and reserved time for a lesson, treatment, consultation or other booked service, and therefore the services of JinKei are not used at the reserved time, no (financial) arrangement will be made for the appointment that was not attended.

11.2 Cancellation by customer

The participant can cancel his registration free of charge up to 24 hours before the start of the planned session. This can be done by email to info@JinKei.com. If the participant cancels his booking within 24 hours before the start of a planned private session, no refund of amounts already paid will be made.

11.3 Cancellation by JinKei

JinKei reserves the right to cancel a scheduled (private) session, training or treatment or any of the other services offered due to force majeure. In that case, an alternative date will be agreed in consultation with the participant/student. Both parties must make every effort to plan this reasonably and fairly.

Article 12 Force majeure

12.1 In these general terms and conditions, force majeure is understood to mean, in addition to what is understood in the law and jurisprudence, all external causes, foreseeable or unforeseeable, on which JinKei cannot exercise any influence, but JinKei is not able to fulfill its obligations. . This includes in any case, but not exclusively: fire, accident, illness, strike, riot, war, government measures, natural disasters such as floodinging, other extreme weather conditions such as heat waves, extended power outages, prolonged interruption of an internet connection, transport obstacles and the threat of terrorism. JinKei does not owe a refund of already paid (registration) fees in the event of force majeure.

12.2. During the force majeure, JinKei's obligations are suspended. If fulfillment of the obligation is no longer possible due to force majeure, both parties are entitled to dissolve the agreement, without there being any obligation to pay compensation. For already performed treatments, training and/or consultations, the payment obligation of the customer remains.

12.3. If JinKei has already partially fulfilled its obligations at the commencement of the force majeure, or can only partially fulfill its obligations, JinKei is entitled to invoice the already performed separately and the customer is obliged to pay this invoice as if it were a separate agreement. .

Article 13 Prices and payment

13.1 Prices. All current prices are listed on the website. JinKei reserves the right to change prices. Payment for services is made via the payment method stated on the website. If a separate payment arrangement is desired, a request must be submitted to contact@JinKei.fr.

13.2 Direct Debit. If there is a direct debit and the amount cannot be collected, the customer will receive a payment reminder with the request to pay the amount due within three working days. If the amount due has not been received by then, an administration fee of € 25.00 will be charged. With a 2nd reminder, another € 25.00 will be added. Payment reminders must be paid within three days. JinKei reserves the right, in the event of non-payment, to suspend the services to be provided by the relevant student or customer until payment has been made. If it concerns a training, JinKei may in certain cases decide not to continue or to complete the training.

13.3 One-off payments

Payment for individual training courses, private sessions, consultations, gift vouchers, workshops, courses and retreats can be made by bank transfer, or by a payment method as stated on the website. JinKei has the right to refuse participation of the registered student or treatment or one of the other services offered, if the participant has not fulfilled his payment obligations in time. Refunds of the tuition fees are not possible.

13.4 Payment by check

JinKei is never obliged to accept checks and can attach conditions to acceptance of such means of payment. The same applies to other payment methods not mentioned here.

13.5 Price change

JinKei reserves the right to change the prices of memberships, individual lessons, private sessions, treatments, gift vouchers, workshops, courses, retreats and other products and services without prior notice.

13.6 The prices are expressed in Euros

The prices include VAT, taking into account the French VAT applicable on the day of invoicing. If the VAT were to change, our prices would be discounted immediately according to the new applicable rate.

Article 14 Liability

14.1 Any liability of JinKei for damage of any kind is excluded, except in the event that this damage is caused by intent or willfully reckless act of managers of JinKei. JinKei does not accept any liability for physical and/or mental injury or injury. JinKei is never liable for loss, theft or damage to personal property.

14.2 JinKei is also under no circumstances liable for:

1. Damage to the user or third parties that is the result of the provision of incorrect or incomplete documentation or information by the user to JinKei, even when this information and documentation originates from third parties, or damage that is otherwise the result of instructions, acts or omissions of the user.

2. damage caused to the user or third parties as a result of acts or omissions of auxiliary persons or suppliers engaged by JinKei;

14.3 Handling knowledge by the student

We emphasize that according to the Usui Reiki method that we offer in our JinKei trainings, it is not possible for the student to give training to third parties or to train third parties until one is an accomplished and initiated Reiki Master. This will therefore only be after completing the training, up to and including the initiation during the Reiki 3rd degree module, which must be completed to the satisfaction and approval of the Reiki Master of JinKei. If the student deviates from the above and in the meantime a training or training courseg to third parties, JinKei waives this completely and accepts no liability or claim for compensation for any form of damage arising from this.

During the training, the student may treat third parties according to the modules learned. The course participant's actions and advice to his or her own clients are entirely at the student's own expense, as JinKei has no influence on these individual treatments.

14.3 Injury

JinKei works with qualified teachers and always ensures high quality services. JinKei always puts the mental and physical well-being of the students and customers first. By participating in a training, consultation or treatment at or provided by JinKei, the student and/or customer accepts that he/she participates voluntarily and thereby accepts the consequences inherent in the Reiki treatments, consultations and training. In addition, the student and/or customer is at all times obliged to obtain the medical advice of an expert doctor or medical specialist if JinKei advises this or if the participant/custodian deems this necessary. JinKei has no role in the sense of a doctor or medical specialist.

JinKei recommends the following:

• Consult a doctor if you deem it necessary;

• If you have an injury or other physical or mental discomfort, or are taking medication, always report this to the relevant practitioner/Reiki Master before starting the training, treatment or consultation;

• Listen carefully to the instructions of the relevant practitioner/Reiki Master and follow them;

• Listen carefully to your body's signals and act carefully

• Ask questions when you don't understand an explanation or experience. This is possible at any time, even if the consultation has already taken place or the training has already ended.

Article 15 - Timetable

15.1 Changes to the agreed schedule. JinKei reserves the right to change the class schedule at any time. Any changes will be announced in advance in JinKei by email.

Cancellations lessons. JinKei reserves the right to cancel or reschedule a scheduled class or appointment due to force majeure. In that case, no refund of amounts already paid will be made. See article 12.

Article 16 Nature of the consultations and training sessions

16.1 Participation at your own risk. JinKei expressly points out by means of these conditions that the customer expressly acknowledges the nature of Reiki treatments by participating in training, and by undergoing consultations and all other common services of JinKei. By accepting the general and additional terms and conditions, the customer and student and/or treated person declare that he/she consciously accepts this liability for himself or possibly for the (underage) children.

JinKei will in turn make every effort to respect the mental and physical condition of the participant/student and/or treated person and, where necessary, refer them to a medical specialist. (See disclaimer)

16.2 Treating customers with respect

JinKei also declares that consultations and training will take place with physical and mental respect towards the participant/student/treated person in the broadest sense of the word.

16.3 (Minor) Children. (Minor) children are only treated with the consent of their parent(s) or legal representative(s). Children and minors must always be accompanied by their parent(s) or legal representative(s). A minimum age of 16 years applies to booking training courses or workshops, unless otherwise agreed in consultation with the candidate student and parent(s) and/or legal representative(s).

Article 17 Terminating, changing and pausing consultations or training sessions

17.1 Notice period

Termination of a treatment series or training is only possible in consultation with JinKei (taking into account the minimum registration period) with a notice period of one month. Cancellation must be made in writing by email to contact@jinkei.fr. Only after the customer has received confirmation by e-mail that the cancellation has been received in good order, is there a legally valid cancellation. The only valid reason to end a course of treatment or training early is illness/hospitalization. The student must submit a doctor's certificate to JinKei.

17.2 Increase, decrease treatment series

It is possible, after consultation with JinKei, to increase or decrease the booked treatment series to a treatment series with a different number. There is a change period in this case and the student must request the change before the fifteenth of the month via e-mail (contact@jinkei.fr), to take effect the first of the month after. Only after the student has received confirmation by e-mail that the increase/decrease has been received in good ordercatch, there is a legally valid increase/decrease. When converting to a treatment series of fewer sessions than the original treatment series, JinKei is not obliged to reimburse the treatments not received. All consultations not attended will lapse, unless otherwise agreed.

17.3 Canceling or pausing in case of illness/injury/pregnancy

It is possible to terminate a training or treatment/treatment series due to complications as a result of pregnancy. Termination must take place in writing via e-mail (contact@jinkei.fr) before the fifteenth of the month, to take effect on the first of the following month. Only after the student has received confirmation by e-mail that the cancellation has been received in good order, is there a legally valid cancellation. The consultations that are still open and/or not followed will therefore be cancelled. It will be determined in consultation with JinKei and the customer whether the training or consultation can be resumed at a later date. JinKei is not obliged to refund amounts already paid.

17.4 Pausing in case of illness/injury/pregnancy

Pausing a treatment series, consultations or training is only possible in exceptional cases. A valid reason to pause a course of treatment, consultation or training is illness/hospitalization/pregnancy. The student must submit a doctor's certificate to JinKei. A second valid reason to pause a course of treatment, consultation or training is an unexpected absence from France for longer than one (1) month. In consultation, the student and JinKei determine the duration of the break and the possibility of resuming the agreed service. The request for a break must be made before the fifteenth of the month via email (contact@JinKei.fr) to take effect on the first of the following month. It is not possible to retrospectively pause a treatment series, consultation or training. At the start of the break, an end term for the break is agreed. This period is a minimum of two calendar months and a maximum of six calendar months. If the customer still decides during the break or after the start date of resumption that he does not want to follow up on the treatments, consultations or training, this is possible with due observance of the notice period referred to in Article 7.1.

17.5 Rate and holidays

When booking JinKei's services and accepting the offered schedule, the customer is expected to immediately notify planned holidays and already known appointments. This means that if the customer is absent due to vacation and should have known this when booking, there will be no refund of the treatment, consultation or training day that has not been taken. Missed lessons can be made up in accordance with article 3.1.5.

Article 18 House rules

18.1 House Rules All students and customers must always follow the JinKei house rules below:

• Make sure you are present (online) at least five minutes before the start of the appointment so that the appointment can start at the indicated time;

• Wear comfortable clothing;

• Sexual behavior or sexually suggestive behavior is not tolerated by JinKei. The (physical) integrity of course participants and customers must always be respected;

18.2 Denial of Access. JinKei reserves the right to deny access to JinKei to students or customers who, in its opinion, do not comply with the house rules, as referred to in Article 10.1, and to terminate any further training, treatment or consultation of the relevant customer without refund of any amounts already paid.

18.3 Confidentiality and Confidential Information. JinKei, as well as anyone who works on behalf of JinKei, undertakes to observe secrecy with regard to all data of the client and customer that are known or likely to be confidential. This secrecy continues after termination of the assignment.

Article 19 Personal data

19.1 Collection of personal data. JinKei collects personal data from students and customers for maintaining its customer base, for executing payment orders and for administration. JinKei handles this collection of personal data with care and always adheres to the provisions of the Personal Data Protection Act.

19.2 Use of personal data. JinKei also uses the personal data referred to in Article 14.1 to inform students and customers about JinKei's activities and any changes in, for example, the schedule. If the customer does not wish to receive communication from JinKei, this can be communicated in writing via e-mail to: contact@JinKei.fr. The student and customer are aware that in that case it may not be possible to use all services and products of JinKei.

19.3 Transfer of personal data. JinKei never gives the personal data of the students and participants without prior noticewritten permission to third parties.

Article 20 Intellectual property

20.1 Training content

Although the contents of JinKei's training courses are not unique due to the nature of the training, all training material has been specially compiled by JinKei and therefore the student is prohibited from using the training material provided by JinKei to the student and customer and the to communicate or share information with third parties or to publish it in any way without the prior consent of JinKei.

20.2 Social Media and the Internet

In view of the confidentiality of the content of the training courses, treatments and consultations, the customer or client is prohibited from publishing the topics discussed and the experiences gained during JinKei's appointments and training sessions on social media and the internet. This means that these agreements are treated under strict confidentiality by both parties. JinKei is not responsible and liable for statements made by students and customers and the consequences thereof if they do not comply with this article.

20.3. The content of its own blogs posted on JinKei's website under the item 'Blogs', and the product descriptions on the website, as well as the training folders, are subject to the intellectual property and copyright of JinKei. Any reproduction of this content, in whole or in part, is strictly prohibited and may constitute a counterfeit. The customer is therefore prohibited from any form of reproduction or exploitation of said blogs and all other articles and descriptions published on the JinKei website, as well as the training content, without the express written consent of JinKei (the provider), who can provide financial compensation to them. to condition.

Article 21 - Applicability of law and dispute settlement

21.1 French law

21.1.1. These Additional Terms and Conditions for Consultations and Training are exclusively governed by French law.

21.1.2. If one or more provisions in these general terms and conditions or in the additional terms and conditions are regarded as unreasonably onerous in legal proceedings, the other provisions will remain in full force and effect.

21.2 Dispute Resolution

Deviations from these general terms and conditions and any additional terms and conditions are only binding if confirmed in writing by JinKei. Any disputes related to the general terms and conditions, treatment, training or consultation, or taking lessons or purchasing other products and services from or from JinKei will be settled at the competent court in France.


Terms and Conditions for Internet Sales

Article 3 Rates

3.1 The prices stated for the items offered are exclusive of processing, shipping, transport and delivery costs, which will be charged extra. In addition, customs costs may be charged additionally by the carrier on delivery. These costs are borne by the buyer.

3.2 The prices are expressed in Euro TTC. Article 4 Payment conditions

4.2 The transaction and online payment other than bank transfer is managed directly by the banking service and is fully secured by the SSL (Secure Socket Layer). The banking service's general terms and conditions apply to the processing of payments by the banking service.

4.3 The products remain the property of JinKei until full payment of the price.

Article 5 Shipping rates and shipping conditions

5.1 JinKei uses La Poste France's rates to determine shipping costs and conditions. These rates are subject to change and will therefore be adjusted if La Poste France changes them.

5.2 Products purchased by the buyer are delivered within a period of 3 to 5 working weeks to the address specified by the buyer when ordering on the site.

5.3 If the product is not in stock and must be ordered from the manufacturer, the delivery time will be longer.

5.4 Except in special cases or when one or more products are not available, the ordered products are delivered in one shipment. JinKei cannot be held responsible for the unavailability of one or more products of the total order.

5.5 Deliveries are handled by La Poste France or by an independent courier. JinKei makes every effort to deliver the products ordered by the buyer within the period specified above. However, these terms and conditions are provided for information purposes and any exceeding may not give rise to any compensation or interest, no deduction or cancellation of the order by the buyer.

5.6 However, if for any reason the ordered products are not delivered within 6 working days from the indicative delivery date, due to force majeure, the sale will be canceled at the written request of the buyer or JinKei. Amounts paid by the buyer will be refunded without undue delay, exclusive of any compensation or deduction.

5.7 JinKei fulfilled its delivery obligation as soon as it delivered the sold goods to the courier service, which accepted them without reservation. The buyer acknowledges that it is the carrier who is responsible for the delivery and therefore cannot rely on JinKei in the event of non-delivery of the transported goods.

5.8 In case of deviation from the standard dimensions of the goods to be delivered, JinKei will provide a quotation and an additional specific invoice from JinKei regarding the delivery conditions, packaging or transport of the ordered products to the buyer. Packages are shipped in perfect condition from the warehouse. Upon delivery, it is the buyer's responsibility to check the condition and number of packages and to check them in the presence of the delivery person. The buyer must clearly state his name and signature on the receipt or electronic device. The signature on the receipt, or on the electronic device, confirms the receipt of the packages and also that they have been received in perfect condition.

5.9 In the event of damage, it is necessary to note the condition of the package on the invoice at the time of delivery, to describe the damage found and to indicate the number of damaged packages. Please note that unspecified comments such as "subject to unpacking", "package refused" or "damaged package" have no value and do not allow the carrier to handle the damage.

5.10 The buyer has a period of 72 hours from the date of delivery to confirm in writing (e-mail) any comments regarding the receipt of the parcels by the courier at the time of delivery or claims for non-to report compliance or defect of the goods, stating an indication and specification of the delivered products, together with all relevant supporting documents. After this period and if these formalities are not fulfilled, the products are considered to be delivered in accordance with the conditions and without defects and no claim can be validly accepted by JinKei.

5.11 JinKei will replace the products with an apparent defect or lack of compliance by the company as soon as possible and at its own expense, if the complaint is justified and the defects/comments are correctly and clearly indicated. Contact JinKei Customer Service for a shipping quote for non-standard size products for Corsica, DOM-TOM and the Overseas Islands. Shipping costs for products with a standard size, according to the dimensions used by La Poste, up to and including 30 kg are automatically calculated during the order.

5.12 Once your order has been registered, JinKei will prepare and ship your order within 7 days when all your items are in stock, and approximately 3 to 5 business weeks for the custom products or products to be ordered from the manufacturer .

Article 6 Transfer of ownership - Transfer of risk

Unless the retention of title clause referred to in Article 4 applies, the transfer of ownership of JinKei's products and the corresponding transfer of the risks of loss and deterioration associated therewith will take place upon acceptance of the order by JinKei, the conclusion of the agreement between the parties about the product and the price, regardless of the date of payment and delivery. The products therefore travel at the expense and risk of the buyer who, in the event of damage, can assert all claims against the carrier under the applicable legal and regulatory conditions.

Article 7 Right of withdrawal

7.1 The buyer has a legal withdrawal period of 7 working days after receipt of the products to return them to JinKei for an exchange or refund without having to justify or pay any fines except for return costs, which are the responsibility of the buyer.

7.2 Products must be returned in their original packaging, unused and in perfect condition within 15 days of delivery.

7.3 Excluded from the right of withdrawal are custom-made items for the buyer.

7.4 Items that are no longer in the original packaging, visibly used, damaged, soiled or incomplete, will not be accepted and can therefore not be returned.

7.5 The shipping costs for the returns are the sole responsibility and for the account of the buyer.

7.6 The return of the products must be preceded by an authorization from JinKei Customer Service (by email: contact@jinkei.fr or via your personal account at www.JinKei.fr and must be accompanied by a copy of the delivery note and the invoice.

7.7 The exchange (subject to availability of items) or refund will be made within 15 days of receipt of the items returned by the buyer, by JinKei.

7.8 In case of abnormal - or abuse of - the possibility of returns, JinKei reserves the right to refuse future orders from the customer.

Article 8 Returns, exchanges

8.1 For any request for return or exchange, the customer has a period of 10 working days after receipt of the packages.

8.2 The return of the products must be preceded by an authorization from JinKei Customer Service (by email: contact@JinKei.fr or via your personal account at www.JinKei.f) and must be accompanied by a copy of the delivery note and the invoice.

8.3 The return shipment to JinKei must be provided with the customer number and the corresponding invoice number, JinKei Customer Service will provide you with instructions.

8.4 Packages must be returned to JinKei in perfect condition and in their packaging. Items that are no longer in the original packaging, damaged, soiled or incomplete will not be accepted and can therefore not be returned.

8.5 Custom-made items for the buyer may not be returned or exchanged.

8.6 For any return due to a demonstrable error by JinKei, the shipping costs will be borne by JinKei.

8.7 For returns for personal convenience of the customer, the costs of return, transport and the packages will be deducted from the credit provided to the customer.

8.8 In case of abnormal or abuse of the possibility of returns, JinKei reserves the right to refuse future orders from the customer.

Article 9 JinKei's Liability - Warranty

9.1 The products supplied by JinKei are in accordance with the legalProvisions: - The legal guarantee of conformity the legal guarantee against hidden defects resulting from defects in material, design or manufacturing that affect the delivered products and make them unfit for use under the manufacturer's warranty, depending on the products and brands concerned.

9.2 Any warranty is excluded in case of misuse, negligence or lack of maintenance on the part of the purchaser, such as normal wear and tear of the good, accident or force majeure and JinKei's warranty is limited to replacement or refund of non-conforming or defective products.

9.3 In order to assert its rights, the buyer must, under penalty of forfeiture of any action in this regard, within a maximum period of 7 days from the date of receipt and discovery, notify JinKei in writing (via email contact@JinKei.fr) establish the existence of the defects.

9.4 JinKei will replace or repair any products or parts deemed to be covered by the warranty. The products sold on the website comply with the regulations in force in France. JinKei shall not be held liable in the event of the purchaser's failure to comply with the laws of the country where the products are delivered.

9.5 The characteristics of the products may be changed or improved without notice (in advance), as a result of which the photos, texts and illustrations accompanying the products on the website and in the catalog have no contractual value and JinKei cannot be held liable for this.

9.6 The buyer is solely responsible for the choice of the products, their storage and use. All products on the www.JinKei.fr website must be used under the supervision of adults and/or users who are familiar with the techniques and skills for which the products are intended and intended.

9.7 JinKei shall not be held responsible or liable for any delay or non-compliance resulting from the occurrence of a force majeure event commonly recognized by French jurisprudence.

Article 10 – Collection and storage of personal customer data

10.1 In accordance with Law 78-17 of January 6, 1978, it is recalled that the personal data requested from the buyer is necessary for the processing of his order and the preparation of invoices.

10.3 When the buyer completes his order, we ask for his email address. This is necessary for processing the order. This email address is used solely by JinKei and will not be transferred or sold to third parties. By entering the email address, the buyer agrees that JinKei will use this email address to inform the buyer about (future) products and services. This can also be in the form of a newsletter. The buyer has the right to unsubscribe from this newsletter or e-mails at any time via the link sent in the respective e-mail.

Article 11 Intellectual property

11.1 The content of the site is the property of JinKei and its partners and is protected by French and international laws regarding intellectual property. Any reproduction of this content, in whole or in part, is strictly prohibited and may constitute a counterfeit.

11.2 In addition, JinKei (the contractor) and/or the cooperating supplier/manufacturer, remains the owner of all intellectual property rights in the studies, drawings, models, prototypes, etc. made (even at the request of the customer) for the provision of services to the customer. The customer is therefore prohibited from any form of reproduction or exploitation of said studies, drawings, models and prototypes, etc. without the express written consent of JinKei (the provider), who can condition them to a financial compensation.

Article 12 Applicable law - Language

By express agreement between the parties, this contract is based on and subject to French law. It is written in French, which is leading. This Dutch version is intended as a service to our Dutch speaking customers and should be regarded as such.

Article 13 Disputes

All disputes to which this contract may give rise, concerning its validity, interpretation, execution, termination, execution and consequences, shall be submitted to the competent courts under general law. In case of dispute with professionals and/or merchants, the courts of JinKei's place of business (France) are competent.

Article 14 Buyer's acceptance
